THE SHORT VERSION

  - What Enbodie is: an app that gives you information about your skin, your
    health and the products you use, so you can make informed choices. It's
    not a doctor, and it doesn't diagnose or treat anything (see section 16).

  - Your privacy: your photos, videos, name and address stay on your device.
    We only receive the health data points and profile details you share. If
    you opt in, we may sell aggregated, non-identifying insights to partners -
    never anything that identifies you. See our Privacy Policy.

  - Age: you need to be 13 or over. Under-16s need a parent or guardian to set
    things up and consent.

  - Subscriptions: some features are paid and renew automatically until you
    cancel. You can cancel any time.

  - Your content is yours. You keep ownership of anything you create.

1. ABOUT US

1.1 Who we are

These Terms & Conditions apply to the Enbodie mobile application ('App'), the
Enbodie website at enbodie.me ('Website'), and all related services, features
and content (collectively, the 'Services') provided by Enbodie Ltd ('Enbodie',
'we', 'us' or 'our').

Enbodie Ltd is registered in England and Wales with Company Number 15669188.
Our registered office is at 3rd Floor, 86-90 Paul Street, London, EC2A 4NE,
United Kingdom.

1.3 Agreement to terms

By accessing or using the Enbodie App or Services, you agree to be bound by
these Terms & Conditions and our Privacy Policy. If you don't agree to these
terms, please don't use our Services.

We draw your attention to section 15 (Limitation of Liability) and section 16
(Medical Disclaimer), which contain important information about our
responsibilities and the limits of our Services.

2. ELIGIBILITY, AGE AND ACCOUNT REQUIREMENTS
===============================================================

 

2.1 Age requirements

You must be at least 13 years old to use Enbodie.

  - 16 and over: you can create and hold your own Enbodie account, whether
    free or paid.
  - 13 to 15: you cannot buy or hold your own account. You can be given
    age-restricted access to core features only when a parent or guardian adds
    you to their Enbodie Family or Family+ account. The parent or guardian is
    the account holder and consents on your behalf.
  - Under 13: you may not use Enbodie, and we do not knowingly collect data
    from anyone under 13.

We check age when an account is created. Where you sign in with Google or
Apple, your age range is confirmed through their native age-assurance signals
(Apple's Declared Age Range API and Google's Play Age Signals API). Because a
13 to 15 year old can only be given access by a parent through a Family or
Family+ account, the email sign-up route cannot be used to create a standalone
under-16 account.

If you access the Services by misrepresenting your age, you must stop using
Enbodie immediately.

2.2 Account creation

To access certain features, you must create an account. When you do, you agree
to:

  - Provide accurate, current and complete information
  - Maintain and promptly update your account information
  - Keep your account credentials secure
  - Accept responsibility for all activity under your account
  - Notify us immediately of any unauthorised access or security breach

2.3 Account security

You're responsible for safeguarding your password and limiting access to your
device. We recommend strong passwords and enabling any available security
features. You agree not to disclose your password to any third party.

3. DESCRIPTION OF SERVICES
===============================================================

 

3.1 Enbodie platform features

Enbodie is an agentic AI-driven preventative health and wellness platform. We give you
information to help you make informed choices about your skin, your health and
the products you use. The Services include:

  - Health insight: smartphone-based analysis of skin and related health
    markers, using AI that runs on your own device and is informed by clinical
    expertise
  - Ingredient information: assessment of ingredients in personal care
    products against our database (ELI - Enbodie Living Intelligence) and
    government toxicology data
  - Personalised insight: information tailored to the profile details you
    choose to share, such as age, sex and ethnicity
  - Product database: information about products, ingredients, toxicology data
    and ESG factors
  - Skin insight: assessment tools that combine your Fitzpatrick skin
    phototype, profile and health information

The Services give you information and intelligence. They don't provide a
diagnosis, and they aren't a substitute for professional medical advice (see
section 16).

3.2 Personal use only

The Services are for your personal, non-commercial use. You may not use them
for the benefit of any third party, or for any commercial purpose, without our
prior written consent.

3.3 Service modifications

We may modify, suspend or discontinue any part of the Services at any time,
with or without notice. We'll make reasonable efforts to tell you about
significant changes that affect core functionality.

We may also update these Terms from time to time. Continued use of the
Services after changes constitutes your acceptance of the modified terms.

4. YOUR RESPONSIBILITIES AND ACCEPTABLE USE

4.1 Permitted use

You agree to use the Services only for lawful purposes and in accordance with
these Terms. You may not:

  - Use the Services in any way that breaks applicable local, national or
    international law
  - Use the Services to transmit any harmful, threatening, abusive or
    offensive content
  - Attempt to gain unauthorised access to our systems, networks or other
    users' accounts
  - Interfere with or disrupt the Services or connected servers
  - Use any automated system (including robots, spiders or scrapers) to access
    the Services without our written permission
  - Reverse engineer, decompile or disassemble any part of the Services
  - Remove, obscure or alter any proprietary rights notices
  - Impersonate any person or entity, or misrepresent your affiliation with
    any person or entity

4.2 Your content

You create content when you use Enbodie - for example, the images you capture
for skin or health analysis. Because of how Enbodie is built:

  - Your photos and videos are processed on your own device and aren't
    uploaded to or stored by us
  - You keep ownership of your content
  - You grant Enbodie a limited, non-exclusive, worldwide licence to use the
    health data points your device produces, solely to provide the Services
    and give you personalised insight
  - You confirm you have the right to use the content you capture
  - We treat the information derived from your images as sensitive data,
    subject to strict security and privacy protections

4.3 Device and network requirements

You're responsible for:

  - Ensuring your device is compatible with the App
  - Maintaining internet connectivity to access the Services
  - Any charges from your mobile network or internet service provider
  - Getting permission from the bill payer if you're not the account holder
    for your device

5. HEALTH DATA AND PRIVACY
===============================================================

 

5.1 Your health information

Enbodie's design keeps your most sensitive information on your own device.
Your photos, videos, name and address never reach us. What we do process is:

  - The profile details you choose to share (for example, age, sex, ethnicity)
  - The health data points your device produces from your images
  - Health metrics from any wearable or health device you connect, with your
    consent
  - Your product usage and routine information
  - Usage data and technical information

5.2 How we protect your data

We're committed to protecting your health data. We do this by:

  - Keeping your images, videos, name and address on your device, protected by
    your device's own security and biometrics
  - Encrypting the data we do hold, at rest and in transit
  - Limiting access to authorised personnel through secure, role-based
    permissions
  - Using secure cloud storage providers that meet UK and EU GDPR standards

5.3 Privacy policy

Full details of how we collect, use, store and protect your personal data are
in our Privacy Policy, which forms part of these Terms. Please read it
carefully.

6. INTELLECTUAL PROPERTY RIGHTS
===============================================================

 

6.1 Enbodie's proprietary rights

The Services - including the App, Website, ELI & EVI technology and database, algorithms, AI models, AI agents, Machine Learning, content, features, functionality, design and all intellectual property rights
in them - are owned by Enbodie Ltd or our licensors.

Subject to your compliance with these Terms, we grant you a limited,
non-exclusive, non-transferable, non-sublicensable, revocable licence to
access and use the Services for your personal, non-commercial use.

6.2 Trade marks

'Enbodie', the Enbodie logo, 'ELI', ''EVI', Enbodie Living Intelligence' , 'Enbodie Visual Intelligence' and other
marks are trade marks of Enbodie Ltd. You may not use them without our prior
written permission.

6.3 Feedback and suggestions

If you give us feedback, suggestions or ideas about the Services, you grant us
the right to use them without any obligation to compensate you.

7. SUBSCRIPTION AND PAYMENT TERMS
===============================================================

 

7.1 Subscription plans

Enbodie may offer both free and paid plans. Details of available plans,
features and pricing are shown on our Website.

7.2 Billing and automatic renewal

If you buy a paid subscription:

  - It will renew automatically at the end of each billing period unless you
    cancel before the renewal date
  - You authorise us to charge your chosen payment method for the subscription
    fee
  - We'll tell you about any price changes with reasonable advance notice
  - You can manage your subscription and payment details through your account
    settings, or through the platform you subscribed with.

7.3 Cancellation and refunds

You may cancel at any time through your account settings or the relevant app
store. On cancellation:

  - You keep access to paid features until the end of your current billing
    period
  - We don't provide refunds for partial billing periods unless required by law
  - We may offer refunds at our discretion on a case-by-case basis

7.4 Free trials

We may offer free trials for certain plans. If you don't cancel before the
trial ends, you'll be charged the applicable fee. We may limit free trial
eligibility.

8. THIRD-PARTY SERVICES AND LINKS
===============================================================

 

8.1 Third-party integrations

The Services may integrate with wearables, health devices and third-party
health platforms you choose to connect (for example, fitness trackers and
smartwatches). Your use of any third-party device or service is governed by
its own terms and privacy policies. We aren't responsible for the practices of
third-party services.

8.2 Third-party links

The Services may contain links to third-party websites or services. We don't
endorse or take responsibility for any third-party content, products or
services. You access them at your own risk.

9. DATA RETENTION AND ACCOUNT DELETION

9.1 Data retention

We keep your personal data only for as long as we need it to fulfil the
purposes for which it was collected, comply with legal obligations, resolve
disputes and enforce our agreements.

9.2 Account deletion

You may delete your account at any time through the App settings, or by
contacting dpo@enbodie.me. On account deletion:

  - Your account and profile are removed from our active systems
  - We delete or anonymise your personal data in line with our Privacy Policy
    and legal obligations
  - Some data may remain in backups for a limited period
  - We may keep certain data where required by law, or for legitimate business
    purposes (such as fraud prevention)

9.3 Right to download your data

You can download a copy of your personal data at any time. See our
'Downloading Your Data' documentation, or contact dpo@enbodie.me.

10. AGGREGATED AND ANONYMISED DATA
===============================================================

 

10.1 Use of aggregated data

We may combine data into aggregated insights: statistics and patterns across
groups of users. We shape these so that no individual can be singled out - we
report on groups rather than people, we set a minimum group size, and we
suppress rare combinations that might point to one person. None of this
includes your images, name or address, which never leave your device.

Where you have opted in, we may use these aggregated insights to:

  - Improve our platform and AI (Artificial Intelligence), ML (Machine Learning)
  - Carry out research on health trends, ingredient safety and product
    efficacy
  - Share or sell aggregated insights to research and industry partners
    through our Data as a Service marketplace
  - Support ethical product reformulation and innovation

These aggregated insights can't identify you and aren't personal data.
Including your data in them is your choice: you can opt in or out at any time
in Settings, and you can use the rest of the Services either way. We never
sell data that identifies you, and we never include data from users under 18
in these aggregated insights.

10.2 Examples of aggregated data use

Aggregated insights might include:

  - The percentage of users with a given skin type who report sensitivity to
    certain ingredients
  - Trends in allergen identification across demographics
  - Product compatibility patterns across age groups or ethnicities

This data can't directly or indirectly identify you, and it isn't personal
data under applicable law.

11. INTERNATIONAL DATA TRANSFERS
===============================================================

 

Your information may be stored and processed in countries outside your country
of residence, including the United States and other places where Enbodie or
our service providers maintain facilities.

By using the Services, you consent to the transfer of your information to
countries outside your country of residence, which may have different data
protection laws. We'll ensure appropriate safeguards are in place to protect
your data in line with applicable law.

12. TERMINATION AND SUSPENSION
===============================================================

 

12.1 Termination by you

You may stop using the Services at any time by deleting your account, as
described in section 9.

12.2 Termination or suspension by Enbodie

We may suspend or terminate your access at any time, with or without notice,
if:

  - You break these Terms
  - You engage in fraudulent, illegal or harmful activity
  - Your account has been inactive for an extended period
  - We're required to by law
  - Continued provision of the Services poses a security or legal risk

12.3 Effect of termination

On termination of your account:

  - All licences granted to you under these Terms end immediately
  - You must stop using the Services
  - We may delete your account data in line with our Privacy Policy
  - Sections that by their nature should survive termination remain in effect,
    including sections 6 (Intellectual Property), 15 (Limitation of
    Liability), 16 (Medical Disclaimer) and 18 (Governing Law)

13. UPDATES AND MODIFICATIONS

13.1 App updates

We may release updates, patches or new versions of the App from time to time.
You may need to update the App to keep using the Services. Some updates may be
automatic; others may need manual installation.

13.2 Changes to terms

We may modify these Terms at any time. We'll tell you about material changes
by:

  - Posting a notice in the App or on our Website
  - Sending an email to the address linked to your account
  - Asking you to accept the updated Terms at your next login

Your continued use of the Services after the effective date of modified Terms
constitutes your acceptance of the changes.

14. USER SUPPORT AND COMPLAINTS

14.1 Customer support

Our support team can help with questions, technical issues or concerns.

14.2 Complaints procedure

If you have a complaint about the Services:

  1. Contact our support team at support@enbodie.me with details of your
     concern
  2. We'll acknowledge your complaint within five business days
  3. We'll investigate and respond with a resolution or explanation within 28
     days
  4. If you're not satisfied, you can escalate to our Data Protection Officer
     at dpo@enbodie.me

14.3 Regulatory complaints

You have the right to complain to the Information Commissioner's Office (ICO),
the UK supervisory authority for data protection, at ico.org.uk. We'd
appreciate the chance to address your concerns first.

15. LIMITATION OF LIABILITY

15.1 Service provision 'as is'

The Services are provided on an 'as is' and 'as available' basis, without
warranties of any kind, express or implied, including warranties of
merchantability, fitness for a particular purpose, or non-infringement.

15.2 No guarantee of accuracy

While we work to provide accurate, reliable information:

  - We don't guarantee the Services will be uninterrupted, timely, secure or
    error-free
  - We don't warrant the accuracy, completeness or reliability of any content,
    analysis or recommendations
  - We don't guarantee that defects will be corrected, or that the Services
    are free from viruses or other harmful components

15.3 Limitation of liability

To the fullest extent permitted by law:

  - Enbodie, its officers, directors, employees and agents won't be liable for
    any indirect, incidental, special, consequential or punitive damages
    arising from your use of the Services
  - Our total liability for any claims arising from or related to the Services
    won't exceed the amount you paid Enbodie in the 12 months before the
    claim, or £100, whichever is greater
  - This limit applies regardless of the legal theory the claim is based on

15.4 Exceptions

Nothing in these Terms excludes or limits our liability for:

  - Death or personal injury caused by our negligence
  - Fraud or fraudulent misrepresentation
  - Any liability that can't be excluded or limited under applicable law

16. MEDICAL DISCLAIMER

16.1 Not medical advice

Important: the Enbodie Services don't provide medical advice, diagnosis or
treatment. They're for information and education only.

  - The information, analyses and recommendations in the Services aren't a
    substitute for professional medical advice, diagnosis or treatment
  - Always seek the advice of your doctor or another qualified health provider
    with any questions about a medical condition
  - Never disregard professional medical advice, or delay seeking it, because
    of something you saw in the Services
  - If you think you may have a medical emergency, call your doctor or
    emergency services immediately

16.2 AI-generated content

Our Services use AI and machine learning to analyse information and provide
personalised insight. While we use clinically informed methods:

  - AI-generated analysis may contain errors or inaccuracies
  - Results should be treated as one data point among many in your health
    journey
  - You should verify important health information with qualified healthcare
    professionals
  - Individual results may vary based on many factors

16.3 Ingredient and product information

While we maintain a comprehensive database of product ingredients and safety
information:

  - Product formulations may change without notice
  - Manufacturers may update ingredients not yet reflected in our database
  - Individual reactions to products and ingredients can vary
  - Always read product labels, and consult a healthcare provider if you have
    concerns about specific products or ingredients

16.4 Use at your own risk

You acknowledge and agree that:

  - You use the Services at your own risk
  - Enbodie isn't responsible for any health outcomes from your use of the
    Services
  - You're solely responsible for any decisions you make based on information
    in the Services

17. INDEMNIFICATION

You agree to indemnify, defend and hold harmless Enbodie Ltd, its officers,
directors, employees, agents, licensors and service providers from and against
any claims, liabilities, damages, losses, costs or expenses (including
reasonable legal costs) arising from:

  - Your use or misuse of the Services
  - Your breach of these Terms
  - Your breach of any rights of another person or entity
  - The content you create
  - Any fraudulent, illegal or harmful activity through your account

18. GOVERNING LAW AND DISPUTE RESOLUTION

18.1 Governing law

These Terms, and any dispute or claim arising out of or in connection with
them or their subject matter, are governed by and construed in accordance with
the laws of England and Wales.

18.2 Jurisdiction

You agree that the courts of England and Wales have exclusive jurisdiction to
settle any dispute or claim arising out of or in connection with these Terms
or their subject matter.

18.3 Dispute resolution process

Before starting any formal legal proceedings, we encourage you to contact us
at support@enbodie.me to try to resolve the dispute informally.

19. GENERAL PROVISIONS

19.1 Entire agreement

These Terms, together with our Privacy Policy and any other legal notices or
agreements we publish in connection with the Services, are the entire
agreement between you and Enbodie.

19.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the
remaining provisions continue in full force. The invalid provision will be
replaced with a valid one that most closely matches the original intent.

19.3 Waiver

Our failure to enforce any right or provision of these Terms isn't a waiver of
that right or provision. Any waiver must be in writing and signed by an
authorised representative of Enbodie.

19.4 Assignment

You may not assign or transfer these Terms, or your rights under them, without
our prior written consent. We may assign or transfer these Terms without
restriction.

19.5 Force majeure

We won't be liable for any delay or failure to perform our obligations under
these Terms due to circumstances beyond our reasonable control, including
natural disasters, war, terrorism, pandemics, government actions or technical
failures.

19.6 No third-party beneficiaries

These Terms are for the benefit of you and Enbodie only, and aren't intended
to confer any rights on third parties.

20. INTERPRETATION

20.1 Defined terms

All capitalised terms used in these Terms have the meanings assigned to them
throughout this document or in our Privacy Policy.

20.2 Headings

The headings and section titles are for convenience only and have no legal or
contractual effect.

20.3 Examples

All uses of the word 'including' mean 'including but not limited to', and the
examples given aren't intended to limit the terms they illustrate.

21. APP STORE SPECIFIC TERMS
===============================================================

 

21.1 Apple App Store

If you download the Enbodie App from the Apple App Store, you acknowledge and
agree that:

  - These Terms are between you and Enbodie, not with Apple Inc. ('Apple')
  - Enbodie, not Apple, is solely responsible for the App and its content
  - Apple has no obligation to provide maintenance and support for the App
  - If the App fails to conform to any applicable warranty, you may notify
    Apple, and Apple will refund the purchase price (if any); to the maximum
    extent permitted by law, Apple has no other warranty obligation
  - Enbodie, not Apple, is responsible for addressing any claims relating to
    the App or your use of it
  - Apple is a third-party beneficiary of these Terms in respect of your use
    of the App, and may enforce these Terms against you

21.2 Google Play Store

If you download the Enbodie App from the Google Play Store, you acknowledge and
agree that:

  - These Terms are between you and Enbodie, not with Google LLC ('Google')
  - Enbodie, not Google, is solely responsible for the App, its content and
    any claims relating to it
  - Google is a third-party beneficiary of these Terms in respect of your use
    of the App
  - Your use of the App must comply with Google Play's Terms of Service
